Introduction

These Terms of Service ("Terms") govern the use of the website BuildApt, located at buildapt.site, and the services, digital products, and goods offered by BuildApt. By accessing or using any aspect of BuildApt, you agree to be bound by these Terms.

1. Definitions

"User" means any person who visits or uses BuildApt. "Services" refers to custom software development projects, consulting, and support offerings. "Digital Products" refers to electronic infoproducts such as guides, templates, and tutorials. "Goods" refers to physical items sold through the site.

2. Changes to Terms

BuildApt reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with the effective date of 2025. Your continued use after such changes constitutes acceptance.

3. Use of the Site

Users agree not to engage in prohibited conduct and to comply with applicable laws. BuildApt may suspend or terminate access for violations.

4. User Responsibilities

Users shall provide accurate information, safeguard credentials, and cooperate with project requirements. Unauthorized use is prohibited.

5. Intellectual Property

All content on BuildApt, including code, designs, text, and images, is the property of BuildApt or its licensors. Unauthorized reproduction is prohibited.

6. Disclaimers

All services, digital products, and goods are provided "as is" without any guarantee. BuildApt disclaims all warranties, express or implied.

7. Limitation of Liability

In no event shall BuildApt be liable for any incidental or consequential damages arising from use of the site or products.

8. Service Terms

Custom software development, maintenance, consulting, and support services are described on the site. Project scopes, deliverables, and schedules are defined in separate agreements. Fees are payable as outlined in project proposals.

• Project-Based Services: Clients may request a reimbursement within 14 calendar days from the project start date if no deliverables have been submitted. Approved reimbursements will be processed via the original method of payment within 10 business days.
• Subscription Services: Subscription fees are billed on recurring terms. Clients may pause delivery of services once per subscription term with a minimum 10-day notice. Subscription fees are non-recoverable after the second billing date.
• Consultations and Workshops: Scheduled sessions require 7-day notice for a reschedule or cancellation. No reimbursements are available once a session has been delivered.

9. Digital Product Terms

Digital guides, templates, and tutorials are delivered via download links. Clients have 7 calendar days from purchase to request a reimbursement provided the file has not been fully downloaded. After download completion, no reimbursements are permitted.

10. Goods Terms

Physical items are shipped to the address provided at purchase. Clients may ship back unused goods in their original condition within 30 calendar days of receipt. Shipping back is the client’s responsibility. Inspected items that meet criteria will be eligible for a reimbursement processed via the original payment method.

Clearance and promotional goods are final sale and not eligible for shipment back or reimbursement.

11. Extended Reimbursement Policy

All reimbursement requests must be submitted to our customer support team via contact.php with order details and reasons. Approved reimbursements will be issued by the original method of payment. Alternatively, clients may choose to apply any approved reimbursement credit toward future services or digital products within 6 months from approval date.

BuildApt reserves the right to deny reimbursement requests in cases of misuse or abusive requests. All timelines are based on calendar days unless otherwise stated.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law provisions.
